These Terms and Conditions ("Terms") govern your use of our website and services related to arranging the transport of vehicles and equipment within the United States. By requesting a quote, booking transport, signing any agreement, or paying any amount to King Saf, you confirm that you have read, understood, and agree to these Terms.
2. Nature of Our Services (Broker/Dispatcher Role)
2.1 King Saf operates as a vehicle transport broker/dispatcher. We are not a motor carrier and do not physically transport vehicles. 2.2 Our role is to: - Receive your transport request and details. - Match your shipment with an independent third‑party carrier. - Coordinate scheduling and communication between you and the carrier. 2.3 All actual transportation services are performed by independent carriers that hold their own licenses, insurance, and authority. King Saf is not responsible for the carrier’s independent actions, omissions, or delays, except as required by applicable law.
3. Quotes, Price Lock Promise®, and Bookings
3.1 Quotes - Quotes are based on the information you provide (vehicle type, condition, running status, pickup and delivery locations, timing, and any special requirements). - Quotes are provided in U.S. Dollars (USD) and are valid for a limited time, as stated in the quote. 3.2 Price Lock Promise® - When we confirm your order under our Price Lock Promise®, the total brokered transport price we provide will not increase due to normal market changes, as long as your shipment details remain accurate and unchanged. - If your details change (e.g., different vehicle, inoperable vehicle, extra items in the vehicle, different addresses, or timing changes), we may need to update your price. 3.3 Non‑Binding Nature of Quotes - Until a carrier is assigned and your booking is confirmed, all quotes are estimates and subject to carrier availability and route conditions. 3.4 Booking Confirmation - Your booking is considered confirmed when: - You accept the quote in writing (including electronically), and - You pay any required deposit or booking fee, and - We send you a written confirmation (email or text) with your order details.
4. Payments and Fees
4.1 Currency and Methods - All prices and payments are in U.S. Dollars (USD). - Accepted payment methods will be stated in your quote or invoice (for example: credit/debit card, ACH, or other approved methods). 4.2 Deposit and Balance - A non‑refundable deposit or broker fee may be required to secure your booking and begin the process of assigning a carrier. - The remaining balance, if any, is typically paid directly to the carrier upon pickup or delivery, as specified in your confirmation. 4.3 Additional Charges You may incur additional charges if: - The vehicle is significantly different from what was described (size, weight, modifications). - The vehicle is inoperable or requires special equipment not previously disclosed. - Pickup or delivery locations are changed, inaccessible, or require special arrangements (e.g., narrow streets, gated communities, remote areas). - You are not available at the agreed time and location, causing delays or redelivery. 4.4 Chargebacks and Disputes - Initiating a chargeback without first attempting to resolve the issue with King Saf may be considered a breach of these Terms. - We reserve the right to dispute any chargeback and provide documentation of services rendered.
5. Cancellations, Changes, and Refunds
5.1 Cancellations by Customer - Cancellations must be requested in writing (email or text) using the contact details provided in your confirmation. - Deposits and broker fees are generally non‑refundable once a carrier has been assigned to your order. - If you cancel before a carrier is assigned, partial or full refunds may be considered at King Saf’s sole discretion. 5.2 Changes to Your Order - Changes to pickup/delivery addresses, dates, vehicle details, or vehicle condition must be requested in writing. - Changes may result in updated pricing, new scheduling, or delays in assigning a carrier. 5.3 Cancellations or Changes by Carrier - If a carrier cancels or cannot complete the shipment, King Saf will make reasonable efforts to reassign your shipment to another carrier. - If we are unable to reassign within a reasonable time, you may be entitled to a refund of any unused portion of fees paid to King Saf, subject to review.
6. Customer Responsibilities
By using our services, you agree to: 6.1 Provide Accurate Information - Give complete and accurate details about your vehicle(s), including VIN (if requested), condition, modifications, and running status. - Provide correct pickup and delivery addresses and contact information. 6.2 Prepare the Vehicle - Remove all personal items and valuables from the vehicle unless otherwise agreed in writing. - Ensure the vehicle is in a safe, operable condition if booked as “running.” - Secure or remove loose parts and accessories (e.g., spoilers, racks, covers). 6.3 Availability at Pickup and Delivery - Ensure you or your authorized representative is present at pickup and delivery. - Inspect the vehicle with the carrier and sign the Bill of Lading (BOL) at both pickup and delivery. - Note any visible damage on the BOL at delivery before signing. 6.4 Compliance with Law - You will not use our services for any unlawful purpose. - You will not ship any prohibited items or hazardous materials inside the vehicle.
7. Vehicle Condition, Inspection, and Damage Claims
7.1 Pre‑ and Post‑Transport Inspection - The carrier will typically perform a visual inspection of the vehicle at pickup and delivery and record its condition on the Bill of Lading. - You or your representative must review and sign the BOL at both pickup and delivery. 7.2 Damage During Transport - Any claim for damage must be noted on the BOL at delivery and reported directly to the carrier as soon as possible. - You must also follow the carrier’s and their insurer’s claim procedures, including providing photos, documents, and repair estimates. 7.3 King Saf’s Role in Claims - Because King Saf is a broker/dispatcher and not the carrier, damage claims are generally handled between you and the carrier and/or their insurer. - King Saf may assist with communication but does not guarantee any specific outcome or payment.
8. Transit Windows, Delays, and No Guarantees
8.1 Estimated Pickup and Delivery Windows - Any dates or time frames we provide for pickup or delivery are estimates only. - Actual timing may be affected by traffic, weather, mechanical issues, route changes, regulations, and other factors beyond our control. 8.2 No Guaranteed Delivery Times - Unless expressly stated in a separate written agreement signed by King Saf, we do not guarantee exact pickup or delivery dates or times. 8.3 Delays - King Saf and the carrier are not liable for losses or expenses caused by delays, including but not limited to lost wages, rental car costs, storage fees, or missed appointments, except as required by law.
9. Insurance and Liability
9.1 Carrier Insurance - Carriers are required to maintain their own insurance coverage as required by law. - You may request proof of the carrier’s insurance upon assignment. 9.2 King Saf’s Liability - King Saf does not own or operate the trucks that transport your vehicle and is not responsible for: - Damage caused by the carrier or third parties. - Acts of God, weather, road conditions, or other events beyond our control. - To the fullest extent permitted by law, King Saf’s total liability to you for any claim related to our services is limited to the amount of broker fees you paid to King Saf for the specific shipment at issue. 9.3 Exclusions - We are not liable for: - Pre‑existing damage or mechanical issues. - Damage to personal items left in the vehicle. - Minor cosmetic wear from normal transport conditions (e.g., dust, dirt).
10. Intellectual Property
10.1 Ownership - All content on our website, including text, graphics, logos, and branding (including Price Lock Promise®), is owned by or licensed to King Saf and is protected by applicable intellectual property laws. 10.2 Limited License - You may view and use the website for your personal, non‑commercial use related to arranging transport. - You may not copy, reproduce, modify, distribute, or create derivative works from our content without our prior written consent.
11. Privacy and Data Use
11.1 Privacy Policy - Our collection, use, and protection of your personal information are described in our Privacy Policy, which is incorporated into these Terms by reference. - By using our services, you agree to the practices described in our Privacy Policy. 11.2 Communications - You consent to receive communications from us by phone, text, email, or other methods you provide, for purposes of quotes, bookings, updates, and customer service.
